摘要

数据作为数字经济时代的关键生产要素，其知识产权登记方法对促进数据要素市场化流通具有重要意义。在国家政策层面，数据知识产权保护方向已被明确，相关实践探索正通过3批试点在全国17个省市推进。但由于国家尚未形成统一立法，各试点登记规则在登记主体、登记对象、审查模式、法律效力等方面存在显著差异。针对上述问题，提出一种数据知识产权登记方法：明确“数据处理者”具备登记资格，排除仅单纯控制数据的“数据持有者”，以避免权属冲突；将“数据集合”作为登记标的，并统一其构成要件，即需满足来源合法、经算法加工、具备实用价值、体现智力成果属性4项要求；采用“登记机构形式审查+第三方机构实质审查”模式，引入新型赋能技术提升效率与公信力；在现阶段推行登记生效主义，通过建立强制登记程序构建全国互认的权利凭证体系，以保障交易安全。

Abstract

In the digital economy era

as a key production factor

the data property rights registration method of data plays a significant role in promoting the market-oriented circulation of data elements. The direction for data intellectual property protection has been clarified at the national policy level

and relevant practical explorations are being advanced through three batches of pilots in 17 provinces and cities across the country. However

since unified national legislation has not yet been formed

significant differences are observed in pilot registration rules across various regions

including aspects such as registration subjects

registration objects

review models

and legal effects. To address these issues

a registration method for data intellectual property is proposed: clarifying that "data processors" qualify for registration

while excluding " holders" who merely control data to avoid ownership conflicts; defining "data collections" as registration subjects and unifying their constituent requirements

which must meet the four conditions of lawful sources

algorithmic processing

practical value

and attributes of intellectual achievements; adopting a model of "formal review by registration authorities + substantive review by third-party institutions"

with the introduction of new enabling technologies to enhance efficiency and credibility; currently implementing the doctrine of registration effectiveness

establishing a nationally mutually recognized rights certification system through mandatory registration procedures to ensure transaction security.
