摘要

大数据给人们观察世界带来了全新的视角，也对法律制度造成了一定的影响，而大数据产业的持续发展则有赖于法律制度的明确、稳定和包容。主要研究如何应对大数据带来的安全风险，探讨了大数据商业利用的原则和规则，建议通过加强国内立法争取在国际贸易规则制定中的话语权。

Abstract

Big data offers a new perspective on the world

and therefore will affect the legislation. The sustained development of big data industry depends on the clear

stable and inclusive legal system. The method to deal with security risks caused by big data was discussed

and the principles and rules of commercial exploitation of big data were introduced. China should strengthen national legislation so as to strive for the right to speak of international trade rules.
